Baseline Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Baseline mobile application (the "App"), the website at askbaseline.com (the "Website"), and all related services, features, and content provided by Our Peak Health Inc. ("Baseline," "Company," "we," "our," or "us"), a Delaware corporation (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES.
THESE TERMS INCLUDE AN AGREEMENT TO MANDATORY BINDING ARBITRATION, WHICH MEANS THAT YOU AGREE TO SUBMIT ANY DISPUTE RELATED TO THESE TERMS TO BINDING INDIVIDUAL ARBITRATION RATHER THAN PROCEEDING IN COURT. IF YOU WISH TO OPT OUT OF THE MANDATORY ARBITRATION AGREEMENT, SECTION 14 BELOW DESCRIBES THE PROCEDURES YOU MUST FOLLOW TO DO SO. THESE TERMS ALSO INCLUDE A CLASS ACTION WAIVER, WHICH MEANS THAT YOU AGREE TO PROCEED WITH ANY DISPUTE INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION. THESE TERMS ALSO INCLUDE A JURY TRIAL WAIVER.

1. Acceptance of Terms
By downloading, installing, accessing, or using the App or any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services and must discontinue use immediately.
Your use of the Services indicates your acceptance of these Terms in their entirety. By using the Services, you are deemed to have irrevocably agreed to these Terms.
Please also review our Privacy Policy, which explains how we collect, use, and disclose information about you and is incorporated into these Terms by reference.
2. Definitions
The following definitions apply throughout these Terms:
- App: The Baseline mobile application and all its pages, screens, and features, available for download on the Apple App Store.
- Account: The personal account created by a User to access the Services.
- BaselineScore: The proprietary score (0-100) assigned to a Product by the App based on Baseline's evaluation methodology, analyzing factors including ingredients, nutrition, processing level, and risk factors.
- Company: Our Peak Health Inc., the entity responsible for publishing and operating the App and Services.
- Content: All text, graphics, logos, icons, images, audio, video, data, software, algorithms, databases, scoring methodologies, analyses, and all other elements making up the App, Website, or Services.
- Database: The database of food, supplement, and skincare/cosmetic products evaluated by the App, containing hundreds of thousands of products and growing.
- Household Profile: A feature allowing a User to create profiles for up to six (6) family members with individual dietary preferences and allergen settings.
- Product(s): The food, beverage, supplement, and skincare/cosmetic products referenced in the Database and evaluated by the App.
- Services: The App, the Website, and all related features, content, and services provided by Baseline.
- Subscription: A paid plan providing access to premium features of the App, as further described in Section 5.
- User: Any individual who accesses or uses the App or Services, whether on the free or Subscription version.
- User Content: Any content, data, information, product submissions, feedback, suggestions, or other materials submitted, posted, or uploaded by a User through the Services.
3. Description of Services
3.1 What Baseline Does
Baseline is a health product scanning and evaluation application. The App allows Users to scan or search for Products across three categories -- supplements, food and beverages, and skincare and cosmetics -- and receive a BaselineScore (0-100) based on Baseline's proprietary evaluation methodology.
The BaselineScore is calculated by analyzing a Product's ingredients, nutritional profile, processing level, and risk factors. The score is an opinion based on Baseline's analysis and is intended to help consumers make more informed purchasing decisions. The terms used to describe scores (such as "excellent," "good," "fair," or "poor") refer only to the BaselineScore and do not constitute a judgment on the Product's overall safety, effectiveness, or suitability for any individual.
3.2 Key Features
The Services may include, but are not limited to:
- Product scanning and search: Scan product barcodes or search the Database to view BaselineScores and detailed ingredient analysis.
- Product evaluation: Detailed breakdowns of nutrition, ingredients, seed oils, processing level, and risk factors.
- Dietary preferences and allergen flagging: Customize the App to flag ingredients based on your dietary preferences and allergens. See Section 10 for important limitations.
- Household Profiles: Create profiles for up to six (6) family members with individual preferences and allergen settings.
- Better alternatives: Recommendations for higher-scoring Products in the same category.
- Product submission: Users may submit Products not yet in the Database.
- Camera Usage: The App uses your device camera solely for real-time barcode scanning. Barcode images are processed locally on your device and are not transmitted to our servers or stored. If you voluntarily submit a product photo (to request a product be added to our Database), that image is transmitted to and stored on our servers for processing purposes only.
3.3 Database
Baseline maintains its own proprietary Database of Products. The Database is populated through a combination of manufacturer data, public data sources, and User submissions. Baseline does not guarantee the complete reliability of Product composition information in the Database. The information provided by the App reflects the data available on Product labels and from other sources. Errors of composition or detection may occur. It is the User's responsibility to verify Product composition directly on the Product packaging.
3.4 Independence and Scoring Integrity
Baseline's scoring methodology is independent and objective. No brand, manufacturer, or distributor can pay to influence a Product's BaselineScore. The App may display links or referral options for purchasing Products, and Baseline may earn referral commissions on purchases made through these links. However, referral relationships have no influence on BaselineScores or Product evaluations. Scoring and commerce are entirely independent functions.
3.5 Recommendations
When a Product with a low BaselineScore is scanned, the App may suggest alternative Products with higher scores. These recommendations are generated algorithmically and are not influenced by any commercial relationship. No brand pays or influences Baseline to appear in recommendations.
3.6 Data Currency
Product information in the Database reflects data available at the time of last update and may not reflect current Product formulations, ingredients, or labeling. Manufacturers may change ingredients, formulations, packaging, or labels at any time without notice to Baseline. Baseline endeavors to update Product information regularly but cannot guarantee that all information is current. Users should always verify Product information directly from the Product packaging.
3.7 Brand Disputes and Data Corrections
Baseline is committed to accuracy. If a brand, manufacturer, or distributor believes that their Product's BaselineScore is based on inaccurate or outdated data, they may submit a data correction request to support@askbaseline.com. Baseline will review the request, verify the data against current Product labeling, and update the Database if warranted. Submission of a correction request does not guarantee a change in BaselineScore, as scores are determined by Baseline's independent methodology. Baseline reserves the right to determine, in its sole discretion, the accuracy and relevance of any data used in its scoring.
4. Eligibility and Account Registration
4.1 Age Requirement
You must be at least thirteen (13) years old to use the Services. If you are under the age of thirteen (13), you may not use the Services under any circumstances. If you are at least thirteen (13) but under the age of majority in your jurisdiction, your parent or legal guardian must review and accept these Terms on your behalf, and by using the Services you confirm that your parent or guardian has done so.
We do not knowingly collect personal information from children under thirteen (13). If you become aware that a child under thirteen (13) has provided us with personal information, please contact us at support@askbaseline.com and we will take steps to delete such information and terminate the associated Account.
4.2 Account Creation
Certain features of the Services require you to create an Account. When creating an Account, you agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and promptly update your Account information to keep it accurate, current, and complete;
- Create only one Account per person unless expressly authorized by Baseline;
- Not share your Account credentials with any other person;
- Not create an Account using automated methods (bots or scripts).
4.3 Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to:
- Use a strong, unique password for your Account;
- Notify us immediately at support@askbaseline.com if you believe your Account has been compromised or if there is any unauthorized use of your Account;
- Not allow any third party to access or use your Account.
Baseline cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your Account credentials.
4.4 Account Suspension or Termination
Baseline reserves the right, in its sole discretion and without prior notice, to suspend or terminate your Account if you violate these Terms, engage in prohibited conduct, or for any other reason we deem appropriate. Such suspension or termination shall not entitle you to any compensation or damages.
5. Subscription Terms
5.1 Free and Paid Features
The App offers both free features and a paid Subscription that provides access to premium features. Details of the features included in the free version and the Subscription are described within the App and may change from time to time.
5.2 Pricing
Subscription pricing is displayed within the App at the time of purchase. Prices are in U.S. dollars and include applicable taxes as required. Baseline reserves the right to modify Subscription pricing at any time. Any price changes will apply to billing periods beginning after the effective date of the change.
5.3 Free Trial
New Users may be eligible for a seven (7) day free trial of the Subscription. At the end of the free trial period, your Subscription will automatically convert to a paid Subscription and you will be charged the applicable Subscription fee unless you cancel before the free trial expires. Free trial eligibility is determined by Baseline and may be limited to new Users or other specific groups.
5.4 Billing and Auto-Renewal
Subscriptions are billed through the Apple App Store. By purchasing a Subscription, you authorize Apple to charge your designated payment method for the applicable Subscription fees. Paid Subscriptions automatically renew at the end of each billing period unless you cancel at least twenty-four (24) hours prior to the renewal date.
Your Subscription and billing are subject to the Apple App Store Terms and Conditions, which shall govern in the event of any conflict with these Terms regarding payment processing.
Apple will notify you of upcoming renewal charges in accordance with Apple's notification practices. You may also check your renewal date and manage your subscription at any time through Settings > Apple ID > Subscriptions on your device. It is your responsibility to manage your subscription and be aware of upcoming renewal dates.
5.5 Cancellation
You may cancel your Subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation will take effect at the end of the current billing period. You will continue to have access to Subscription features until the end of the period you have already paid for. No refunds or credits will be issued for partial billing periods, except where required by applicable law.
5.6 Refunds
All payments are non-refundable and non-transferable except as expressly provided in these Terms or as required by applicable law. Refund requests for purchases made through the Apple App Store must be directed to Apple in accordance with Apple's refund policies.
5.7 Future Functionality
Your purchase of a Subscription is not contingent on the delivery of any future features, functionality, or content, nor dependent on any oral or written statements made by Baseline regarding future developments.
6. User Responsibilities and Prohibited Conduct
6.1 General Responsibilities
You are solely responsible for your use of the Services and for ensuring that your use complies with these Terms and all applicable laws and regulations. You agree to use the Services only for their intended purpose -- personal, non-commercial health and wellness information.
6.2 Prohibited Conduct
You agree that you will not, and will not allow or encourage any third party to:
- Misuse the Services: Use the Services for any illegal, unauthorized, or commercially competitive purpose; use the Services in a manner inconsistent with applicable laws or regulations;
- Interfere with the Services: Probe, scan, or test the vulnerability of the Services; violate any security or authentication measures; install, upload, or transmit any malware, viruses, Trojan horses, or other harmful code; interfere with or disrupt the Services, servers, or networks connected to the Services; create an undue burden on the Services or our infrastructure;
- Scrape or harvest data: Use any automated system, including bots, crawlers, scrapers, spiders, or offline readers, to access, copy, extract, or store data from the Services without our prior written authorization; systematically retrieve data from the Services to create or compile a collection, database, or directory;
- Infringe rights of others: Hijack another User's Account; collect personal information about other Users without their consent; impersonate any person or entity or misrepresent your affiliation;
- Submit false information: Add or modify Product composition or ingredient data in a false, misleading, or inaccurate manner; submit fraudulent product information;
- Reverse engineer: Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, algorithms, or underlying methodology of the App, the BaselineScore, or any other aspect of the Services;
- Commercially exploit: Resell, rent, lease, loan, sublicense, distribute, or commercially exploit the Services or any Content; use the BaselineScores, evaluations, recommendations, or other Content for personal gain, profit, or any commercial purpose without Baseline's prior written consent;
- Post objectionable content: Submit content that is defamatory, abusive, threatening, harassing, obscene, discriminatory, hateful, or otherwise inappropriate;
- Circumvent restrictions: Bypass, disable, or interfere with any security, access control, or technological protection measures of the Services.
Any violation of these prohibitions may result in immediate termination of your Account and right to use the Services, without notice or compensation, and without prejudice to Baseline's right to pursue legal action.
7. User-Generated Content
7.1 Product Submissions
Users may submit Products not yet in the Database by providing photos, ingredient lists, and other Product information through the App. By submitting Product information, you represent and warrant that:
- The information you submit is accurate, truthful, and taken directly from the Product's packaging or label;
- Any photographs you submit were taken by you and are of the actual Product;
- You own or have the necessary rights to submit such information and photographs;
- Your submission does not infringe any third-party intellectual property rights.
7.2 License Grant
By submitting any User Content through the Services, you grant Baseline a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in connection with providing, operating, improving, and promoting the Services.
You retain ownership of your User Content, but you acknowledge that Baseline may use it as described above without compensation, attribution, or further consent.
7.3 Responsibility for User Content
You are solely responsible for all User Content you submit. Baseline is not responsible for any errors, omissions, or inaccuracies in User-submitted Product information. Baseline will review reported User Content and take appropriate action, which may include editing, correcting, or removing such content. Users may report inaccurate or objectionable User Content through the in-app reporting mechanism or by contacting support@askbaseline.com. Baseline reserves the right to remove any User Content at any time and for any reason, in its sole discretion.
7.4 Feedback
If you provide Baseline with any feedback, suggestions, ideas, or other communications regarding the Services ("Feedback"), such Feedback is not confidential and becomes the sole property of Baseline. Baseline may use, reproduce, and commercialize such Feedback without restriction, compensation, or attribution to you.
8. Intellectual Property
8.1 Baseline's Ownership
All Content, including but not limited to the App, Website, text, graphics, logos, icons, images, audio, video, software, source code, algorithms, scoring methodologies, the BaselineScore system, the Database, analyses, recommendations, data compilations, and all other elements making up the Services, are the exclusive property of Baseline or its licensors and are protected under U.S. and international copyright, trademark, trade secret, patent, and other intellectual property laws.
Baseline considers its scoring methodologies, product evaluation algorithms, Database structures, and analytical frameworks to be trade secrets and confidential information.
8.2 Limited License to Users
Subject to your compliance with these Terms, Baseline grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to:
- Access and use the Services for your personal, non-commercial purposes;
- Download and install a copy of the App on a mobile device that you own or control, as permitted by the Apple App Store Terms of Service.
This license does not include any right to:
- Access, use, or disclose the source code of the App;
- Copy, modify, distribute, sell, or create derivative works based on the Services or any Content;
- Use the BaselineScores, evaluations, or recommendations for any commercial purpose;
- Remove, alter, or obscure any copyright, trademark, or proprietary notices.
This license terminates automatically if you violate these Terms.
8.3 Trademarks
"Baseline," "BaselineScore," the Baseline logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Baseline or its affiliates. You may not use these marks without Baseline's prior written permission. All other trademarks referenced in the Services are the property of their respective owners.
8.4 Copyright Complaints
If you believe that content on the Services infringes your copyright, you may submit a notification in accordance with the Digital Millennium Copyright Act ("DMCA") to:

Please include all information required by 17 U.S.C. Section 512(c)(3). Knowingly submitting a false claim may subject you to liability for damages and legal fees. Baseline has adopted a policy of terminating, in appropriate circumstances, the Accounts of Users who are repeat infringers of intellectual property rights.
9. Third-Party Content and Links
The Services may contain links to third-party websites, products, services, or other content ("Third-Party Content"). Baseline does not control, endorse, or assume responsibility for any Third-Party Content, including its accuracy, availability, legality, or appropriateness.
Your use of Third-Party Content is at your own risk. You release Baseline from any claims or disputes arising from your access to or use of Third-Party Content. Any purchases you make through third-party links are exclusively between you and the applicable third party, and Baseline bears no responsibility for such transactions.
9A. Marketplace and Product Purchases
9A.1 Baseline Marketplace
The App may include a marketplace feature that allows Users to browse and purchase Products. Products available through the Baseline Marketplace are fulfilled by third-party manufacturers, brands, or distributors. Baseline does not manufacture any Products sold through the Marketplace. Products available through the Baseline Marketplace are fulfilled and shipped directly by third-party manufacturers, brands, or distributors. Baseline does not manufacture, warehouse, or directly sell any Products. Baseline provides the technology platform through which Users may discover and purchase Products from third-party sellers.
9A.2 No Product Warranties
BASELINE MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE QUALITY, SAFETY, EFFICACY, LEGALITY, OR SUITABILITY OF ANY PRODUCT AVAILABLE THROUGH THE MARKETPLACE OR THROUGH REFERRAL LINKS. ALL PRODUCTS ARE PROVIDED BY THIRD-PARTY SELLERS AND ARE SUBJECT TO THE SELLER'S OWN TERMS, CONDITIONS, AND WARRANTIES. BASELINE IS NOT RESPONSIBLE FOR ANY DEFECTIVE, MISLABELED, CONTAMINATED, OR OTHERWISE UNSATISFACTORY PRODUCT.
9A.3 Product Liability
Baseline does not manufacture, formulate, test, or directly sell any Product available through the Services. Baseline has no control over the manufacturing processes, quality control, ingredient sourcing, or labeling practices of any third-party Product seller. To the fullest extent permitted by applicable law, Baseline disclaims all liability for any injury, illness, allergic reaction, adverse health event, or damage arising from the purchase, consumption, application, or use of any Product obtained through the Marketplace or referral links.
9A.4 Referral Commissions
Baseline may earn referral commissions on purchases made through the App. Referral commissions have no impact on BaselineScores, Product evaluations, or recommendations. A Product's inclusion in or exclusion from the Marketplace has no bearing on its BaselineScore.
9A.5 Returns and Refunds for Products
All Product returns, refunds, exchanges, and warranty claims must be directed to the applicable third-party seller or manufacturer. Baseline does not process Product returns or refunds. Baseline is not responsible for any shipping, delivery, or fulfillment issues related to Products purchased through the Marketplace.
10. Health and Medical Disclaimers
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT LIMITATIONS ON THE SERVICES.
10.1 Not Medical Advice
THE SERVICES ARE PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THE APP DOES NOT PROVIDE MEDICAL ADVICE, MEDICAL RECOMMENDATIONS, DIAGNOSES, OR TREATMENT. THE APP IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO BE USED AS ONE. THE SERVICES ARE IN NO WAY INTENDED TO REPLACE A CONSULTATION WITH A QUALIFIED HEALTHCARE PROFESSIONAL, INCLUDING BUT NOT LIMITED TO A PHYSICIAN, DIETITIAN, NUTRITIONIST, ALLERGIST, DERMATOLOGIST, OR OTHER LICENSED PROVIDER.
YOU SHOULD ALWAYS CONSULT WITH A QUALIFIED HEALTHCARE PROFESSIONAL REGARDING ANY QUESTIONS OR CONCERNS ABOUT YOUR HEALTH, MEDICAL CONDITIONS, DIETARY NEEDS, OR THE SUITABILITY OF ANY PRODUCT FOR YOUR INDIVIDUAL CIRCUMSTANCES.
YOU MUST NEVER USE THE APP FOR MEDICAL PURPOSES, AND IN PARTICULAR MUST NEVER NEGLECT, DELAY, OR DISCONTINUE SEEKING MEDICAL ADVICE OR PROFESSIONAL CARE AS A RESULT OF INFORMATION YOU HAVE OBTAINED THROUGH THE APP.
10.1A Sensitive Health Data
The Services collect and process information that may be classified as sensitive health data under applicable law, including dietary preferences, allergens, health conditions, and body metrics. By using the Services and providing this information, you acknowledge the sensitive nature of this data and consent to its processing as described in these Terms and our Privacy Policy. This data is used exclusively to personalize your experience and is subject to the heightened protections described in our Privacy Policy.
10.2 Scores Are Informational Only
The BaselineScore and all evaluations, analyses, and recommendations provided through the App constitute Baseline's opinion based on its proprietary methodology. They are general in nature, intended to help consumers be more aware of the composition of the Products they use, and do not guarantee better health outcomes. One's state of health is determined by numerous factors, including lifestyle, genetics, environment, diet, exercise, and other individual circumstances that the App cannot account for.
The BaselineScore does not constitute a judgment on a Product's overall safety, effectiveness, or fitness for any particular purpose. A low score does not mean a Product is unsafe or unfit for consumption; a high score does not mean a Product is safe or suitable for every individual.
10.3 Allergen and Dietary Flagging Limitations
THE APP'S ALLERGEN AND DIETARY PREFERENCE FLAGGING FEATURES ARE BASED SOLELY ON INGREDIENT LABEL DATA AVAILABLE IN THE DATABASE. THESE FEATURES HAVE IMPORTANT LIMITATIONS:
- No guarantee of allergen absence: Allergen flagging is based on the ingredient information available. It does not account for cross-contamination, shared manufacturing facilities, trace amounts, or undeclared ingredients. The absence of a flagged allergen in the App does not guarantee that the Product is free of that allergen.
- Label data may be incomplete or inaccurate: Product formulations may change without immediate reflection in the Database. Label data may contain errors or omissions.
- Not suitable for life-threatening allergies: Users with severe or life-threatening allergies (including but not limited to anaphylaxis risk) MUST NOT rely on the App's allergen flagging as their sole source of allergen information. Such Users must always verify Product labels independently, contact manufacturers directly, and consult with their healthcare provider.
- Cross-contamination not detectable: The App cannot detect or flag cross-contamination risks, which are not typically listed in standard ingredient labels.
BASELINE EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY ALLERGIC REACTION, ADVERSE HEALTH EVENT, OR INJURY RESULTING FROM A USER'S RELIANCE ON THE APP'S ALLERGEN OR DIETARY FLAGGING FEATURES. USERS ASSUME ALL RISK ASSOCIATED WITH THEIR RELIANCE ON SUCH FEATURES.
10.4 Product Composition Data
Baseline does not guarantee the accuracy or completeness of its analysis of the composition of any Product. The Database evolves as Products are added and modified, and Baseline relies on manufacturer-provided data, publicly available data, and User submissions. Errors of composition, ingredient detection, or data entry may occur. It is the User's responsibility to check the composition of Products directly on the Product packaging to ensure they have current and accurate information.
10.5 Eating Disorders
The content on the App may not be appropriate for individuals who have experienced or are experiencing eating disorders. If you have concerns about your relationship with food, please consult a qualified healthcare professional.
10.6 Assumption of Risk
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICES, INCLUDING ANY RELIANCE ON THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY BASELINESCORES, EVALUATIONS, RECOMMENDATIONS, ALLERGEN FLAGS, DIETARY PREFERENCE FLAGS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICES. YOU ASSUME ALL RISK FOR ANY PRODUCT DECISIONS YOU MAKE BASED ON INFORMATION FROM THE SERVICES, INCLUDING DECISIONS TO PURCHASE, CONSUME, APPLY, OR OTHERWISE USE ANY PRODUCT.
10.7 Household Profiles
You are solely responsible for all use of Household Profiles, including the accuracy of information entered for household members, the dietary preferences and allergens selected for each member, and any decisions made based on information displayed for household members. Baseline is not liable for any adverse event, allergic reaction, or injury experienced by any household member as a result of information provided through the Services. If you set up a Household Profile for a minor, you are solely responsible for verifying Product suitability for that minor and must not rely solely on the App's allergen or dietary flagging features.
Baseline does not independently verify the accuracy of information entered in Household Profiles. If Baseline's Database contains inaccurate Product composition data that results in a failure to flag an allergen or ingredient for a household member, Baseline's liability is limited as set forth in Section 12. Parents and guardians are strongly advised to independently verify all Product ingredients for household members with known allergies or sensitivities.
10.8 Not a Substitute for Label Reading
THE APP IS NOT A SUBSTITUTE FOR READING PRODUCT LABELS. YOU MUST ALWAYS VERIFY PRODUCT INGREDIENTS, ALLERGENS, NUTRITION INFORMATION, AND COMPOSITION DIRECTLY ON THE PRODUCT PACKAGING BEFORE CONSUMPTION, APPLICATION, OR USE. PRODUCT FORMULATIONS MAY CHANGE WITHOUT NOTICE TO BASELINE, AND THE INFORMATION IN THE DATABASE MAY NOT REFLECT THE MOST CURRENT PRODUCT COMPOSITION.
10.9 AI-Generated Content
Certain features of the Services use artificial intelligence ("AI"), powered by third-party AI providers, to generate insights, recommendations, ingredient analyses, and other content. Users should be aware of the following:
Identification: AI-generated content within the App may include product insights, ingredient explanations, health goal relevance analyses, and product comparisons. Content sourced directly from the Database (such as ingredient lists, nutrition facts, and BaselineScores) is data-driven and not AI-generated.
Limitations: AI-generated content is provided for informational purposes only. AI-generated content may contain errors, inaccuracies, or incomplete information. AI does not have access to your personal medical history, current medications, or complete health context.
Drug Interactions and Medical Conditions: AI-generated insights DO NOT account for drug interactions, medication contraindications, individual medical conditions, pregnancy, breastfeeding, or other health circumstances that may affect the safety or suitability of a Product for you. You must consult a qualified healthcare provider before making any changes to your supplement, food, or skincare routine, particularly if you are taking medication or have a medical condition.
Not Personalized Medical Advice: While AI-generated insights may reference your stated health goals, they are general in nature and are not tailored medical, dietary, or clinical recommendations. AI-generated content should not be relied upon as the sole basis for any health, dietary, or purchasing decision.
Baseline disclaims all liability for any actions taken based on AI-generated content. You assume all risk associated with your reliance on AI-generated insights.
11. Disclaimers and Limitation of Warranties
THE SERVICES, INCLUDING ALL CONTENT, BASELINESCORES, EVALUATIONS, RECOMMENDATIONS, ANALYSES, AND ALL OTHER INFORMATION PROVIDED THROUGH THE APP, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BASELINE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT;
- ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE;
- ANY WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;
- ANY WARRANTY THAT THE SERVICES WILL BE AVAILABLE WITHOUT INTERRUPTION, ERROR, OR DEFECT;
- ANY WARRANTY THAT THE DATA, CONTENT, BASELINESCORES, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, COMPLETE, OR CURRENT;
- ANY WARRANTY THAT DEFECTS OR ERRORS IN THE SERVICES WILL BE CORRECTED.
NO EVALUATION, RECOMMENDATION, OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM BASELINE THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
USERS EXPRESSLY AGREE TO USE THE SERVICES AT THEIR OWN RISK AND UNDER THEIR SOLE RESPONSIBILITY. THE USER IS SOLELY RESPONSIBLE FOR ANY DECISIONS MADE BASED ON INFORMATION PROVIDED THROUGH THE SERVICES, INCLUDING ANY DECISION TO PURCHASE, CONSUME, APPLY, OR OTHERWISE USE ANY PRODUCT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES OR LIMITATIONS ON STATUTORY RIGHTS. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS AND LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
12. Limitation of Liability
12.1 Exclusion of Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BASELINE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS (COLLECTIVELY, THE "BASELINE PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR:
- LOSS OF PROFITS, REVENUE, BUSINESS, OR GOODWILL;
- LOSS OF DATA OR DATA BREACH;
- SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE;
- THE COST OF SUBSTITUTE SERVICES;
- ANY OTHER INTANGIBLE LOSSES;
ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF OR INABILITY TO USE THE SERVICES, ANY PRODUCT EVALUATED BY THE SERVICES, OR ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY BASELINE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.2 Cap on Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE BASELINE PARTIES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF OR INABILITY TO USE THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE ACTUALLY PAID TO BASELINE FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
12.3 Basis of the Bargain
THE EXCLUSIONS AND LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN BASELINE AND YOU. THE SERVICES WOULD NOT BE PROVIDED TO YOU WITHOUT THESE LIMITATIONS.
12.4 Jurisdictional Limitations
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, BASELINE'S LIABILITY SHALL BE LIMITED TO THE LOWEST AMOUNT PERMITTED BY APPLICABLE LAW.
12.5 No Third-Party Claims
These Terms are between you and Baseline. No third party, including household members, family members, dependents, or any other individual, may assert any claim against Baseline based on your use of the Services, your Household Profile settings, or your reliance on any information provided through the Services. You are solely responsible for any decisions made on behalf of third parties using information from the Services.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Baseline Parties from and against any and all claims, disputes, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and accounting fees) ("Claims") arising out of or in any way connected with:
- Your User Content, Product submissions, or Feedback;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Your infringement, misappropriation, or violation of any rights of any third party (including intellectual property or privacy rights);
- Any allegation that your User Content caused damage to a third party;
- Any Product purchasing decisions you make based on information from the Services;
You agree to promptly notify Baseline of any such Claims, cooperate fully with Baseline in defending such Claims, and pay all costs, fees, and expenses associated with defending such Claims. Baseline reserves the right to assume exclusive control of the defense or settlement of any Claim, and you agree not to settle any Claim without Baseline's prior written consent.
14. Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
14.1 Informal Dispute Resolution
Before initiating any formal dispute resolution proceeding, you and Baseline agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services ("Dispute") informally. You must send a written notice to Baseline ("Notice of Dispute") that includes: (a) your name and contact information; (b) a description of the facts giving rise to the Dispute; and (c) the relief you seek. The parties agree to negotiate in good faith for at least sixty (60) days from receipt of the Notice of Dispute. If the Dispute is not resolved within this period, either party may proceed to binding arbitration as described below.
14.2 Binding Arbitration
If you and Baseline do not resolve a Dispute through informal negotiation, the Dispute shall be resolved exclusively by binding individual arbitration. By agreeing to these Terms, you are giving up the right to litigate Disputes in court before a judge or jury. All Disputes will be resolved before a neutral arbitrator, whose decision will be final except for a limited right of appeal under the Federal Arbitration Act ("FAA"). Any court with jurisdiction over the parties may enforce the arbitrator's award.
This arbitration agreement involves interstate commerce and is governed by the FAA, 9 U.S.C. Sections 1-16.
14.3 Arbitration Procedures
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (the "AAA Rules"), as modified by these Terms. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879.
The arbitration shall be conducted before a single arbitrator. Hearings may be conducted via videoconference, telephone, or in-person as determined by the arbitrator, with in-person hearings (if any) taking place in New Castle County, Delaware, or another mutually agreed location. In Disputes involving US$10,000 or less, any hearing shall be conducted via videoconference or telephone unless the arbitrator finds good cause to hold an in-person hearing.
The arbitrator may award the same damages and relief to you individually as a court could. The arbitrator may award declaratory or injunctive relief only to you individually, and only to the extent required to satisfy your individual claim.
For consumer arbitrations, you will be responsible only for the consumer filing fee as set forth in the AAA Rules. Baseline will cover all other arbitration costs, including the arbitrator's fees.
14.4 Class Action Waiver
YOU AND BASELINE AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. YOU AND BASELINE AGREE THAT NEITHER PARTY WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. NO ARBITRATION OR PROCEEDING WILL BE COMBINED WITH ANOTHER WITHOUT THE PRIOR WRITTEN CONSENT OF ALL PARTIES TO ALL AFFECTED ARBITRATIONS OR PROCEEDINGS.
IF APPLICABLE LAW DOES NOT ALLOW A WAIVER OF CLASS ACTION PROCEEDINGS, THE ABOVE PROVISION WILL APPLY TO YOU TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
14.5 Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BASELINE EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES. THIS JURY WAIVER APPLIES WHETHER THE DISPUTE IS RESOLVED IN COURT OR IN ARBITRATION.
14.6 Time Limitation on Claims
To the extent permitted by law, any Dispute must be filed within two (2) years after the claim or cause of action first arises. If a Dispute is not filed within two (2) years, it is permanently barred.
14.7 Opt-Out Right
IF YOU DO NOT WISH TO BE BOUND BY THE ARBITRATION PROVISIONS OF THIS SECTION, YOU MUST NOTIFY BASELINE IN WRITING WITHIN THIRTY (30) DAYS OF THE DATE YOU FIRST ACCEPT THESE TERMS. YOUR OPT-OUT NOTICE MUST BE SENT BY EMAIL TO SUPPORT@ASKBASELINE.COM OR BY FIRST-CLASS U.S. MAIL TO:

YOUR NOTICE MUST INCLUDE YOUR FULL NAME, MAILING ADDRESS, EMAIL ADDRESS ASSOCIATED WITH YOUR ACCOUNT, AND A CLEAR STATEMENT THAT YOU DO NOT WISH TO RESOLVE DISPUTES WITH BASELINE THROUGH ARBITRATION. YOUR DECISION TO OPT OUT WILL HAVE NO ADVERSE EFFECT ON YOUR RELATIONSHIP WITH BASELINE OR YOUR ACCESS TO THE SERVICES. IF YOU HAVE PREVIOUSLY NOTIFIED BASELINE OF YOUR DECISION TO OPT OUT, YOU DO NOT NEED TO DO SO AGAIN.
14.8 Exceptions to Arbitration
Notwithstanding the foregoing, either party retains the right to:
- Bring an individual action in small claims court for Disputes within that court's jurisdiction;
- Seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights;
- Bring claims for personal injury or wrongful death arising directly from the use of the Services or any Product purchased through the Marketplace, to the extent that such claims are not subject to mandatory arbitration under applicable law;
14.9 Survival
This Section 14 survives the expiration or termination of these Terms for any reason.
15. Governing Law and Venue
These Terms and any Dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
For any matter not subject to arbitration under Section 14, or in connection with the entry of any judgment on an arbitration award, you irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware. You waive any objection to venue in such courts, including claims of inconvenient forum or lack of personal jurisdiction.
16. Termination
16.1 Termination by Baseline
Baseline may, in its sole discretion and without prior notice, suspend or terminate your access to all or any part of the Services, and/or delete your Account and any associated content or data, if:
- You breach these Terms or any other policies incorporated herein;
- You engage in conduct that Baseline determines is harmful, fraudulent, or illegal;
- You fail to maintain accurate Account information;
- Baseline is required to do so by law;
- Baseline decides to discontinue all or part of the Services; or
- For any other reason Baseline deems appropriate.
16.2 Termination by You
You may close your Account at any time by contacting us at support@askbaseline.com or by using the account deletion feature in the App, if available. Closing your Account does not automatically cancel any active Subscription; you must cancel your Subscription separately through your Apple ID settings as described in Section 5.5.
16.3 Effects of Termination
Upon termination or suspension of your Account:
- Your right to use the Services will immediately cease;
- Baseline will delete your Account data within thirty (30) days, except as required by law or as necessary for Baseline's legitimate business purposes;
- All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions (Section 8), disclaimers and limitation of warranties (Section 11), limitation of liability (Section 12), indemnification (Section 13), dispute resolution (Section 14), and governing law (Section 15).
If your Account is terminated for violation of these Terms, you may not create a new Account without Baseline's prior written permission.
17. Privacy
We care about the privacy of our Users. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is available at askbaseline.com/privacy and is incorporated into these Terms by reference. By using the Services, you agree to the terms of our Privacy Policy.
The Services are hosted in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Services, you consent to such transfer, storage, and processing.
18. Modifications to the Terms
Baseline reserves the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms within the App or on the Website, updating the "Last Updated" date at the top of these Terms, or by providing additional notice (such as email or in-app notification).
Updated Terms will take effect immediately upon posting unless otherwise stated. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and delete your Account.
We encourage you to review these Terms periodically to stay informed of any updates.
19. Modifications to the Services
19.1 Changes to the Services
Baseline may, at its sole discretion and without prior notice, modify, update, suspend, or discontinue any or all parts of the Services at any time, for any reason, including to improve the Services, address technical or security issues, or comply with legal requirements.
Your use of the Services does not entitle you to the continued provision or availability of any particular feature or functionality. Baseline will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
19.2 Beta and Early Access Features
Certain features of the Services may be designated as beta, early access, preview, or experimental ("Beta Features"). Beta Features are provided on an "as-is" basis with no warranties of any kind. Beta Features may contain errors, bugs, or inaccuracies and may be modified, suspended, or discontinued at any time without notice. Your use of Beta Features is at your sole risk, and Baseline shall have no liability arising from your use of Beta Features.
20. General Provisions
20.1 Entire Agreement
These Terms, together with the Privacy Policy and any additional terms or policies incorporated by reference, constitute the entire agreement between you and Baseline regarding the Services and supersede all prior or contemporaneous oral or written agreements, understandings, or representations between you and Baseline.
20.2 Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
20.3 No Waiver
Baseline's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Baseline. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
20.4 Assignment
You may not assign or transfer your rights or obligations under these Terms, in whole or in part, without Baseline's prior written consent. Any attempt to do so without consent will be null and void. Baseline may freely assign or transfer its rights and obligations under these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
20.5 No Agency or Partnership
Nothing in these Terms creates any joint venture, partnership, employment, or agency relationship between you and Baseline. You have no authority to bind Baseline in any manner.
20.6 Force Majeure
Baseline shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, labor disputes, internet or infrastructure failures, epidemics, pandemics, or power outages.
20.7 Electronic Communications
By using the Services, you consent to receive electronic communications from Baseline (e.g., email, push notifications, in-app messages). You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
Push notifications may be sent to your device to provide service updates, scan results, or other information related to the Services. You may opt out of push notifications at any time through your device settings. Opting out of push notifications will not affect your ability to use the core features of the Services.
20.8 Headings
Section headings in these Terms are for convenience only and have no legal or contractual effect.
20.9 Export Compliance
The software supporting the Services may be subject to U.S. export control laws and regulations. You represent and warrant that you are (a) not located in a country subject to a U.S. government embargo, and (b) not listed on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export laws and regulations.
20.10 California Consumer Notice
Under California Civil Code Section 1789.3, California Users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N-112, Sacramento, California 95834, or by telephone at (800) 952-5210.
20.11 Apple App Store Terms
If you access the App on an Apple device, the following additional terms apply:
- These Terms are between you and Baseline, not Apple. Baseline, not Apple, is solely responsible for the App and its content.
- The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Usage Rules set forth in the App Store Terms of Service.
- Baseline, not Apple, is responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Baseline, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App infringes a third party's intellectual property rights, Baseline, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
20.12 Google Play Store Terms
If you access the App on an Android device, the following additional terms apply:
- These Terms are between you and Baseline, not Google. Baseline, not Google, is solely responsible for the App and its content.
- The license granted to you for the App is limited to a non-transferable license to use the App on any Android device that you own or control, as permitted by the Google Play Terms of Service.
- Google has no obligation to furnish any maintenance or support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, Google is not responsible. Any claims relating to the App are the responsibility of Baseline, not Google.

20.13 Additional Terms for Users in the European Economic Area (EEA) and United Kingdom
If you are located in the European Economic Area ("EEA") or the United Kingdom ("UK"), the following additional terms apply:
Data Protection. Our processing of your personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the UK GDPR. You have certain rights under GDPR, including the right to access, rectify, erase, restrict processing, object to processing, and port your personal data. Legal Basis for Processing. We process your personal data on the following legal bases: (a) your consent; (b) the performance of our contract with you (these Terms); (c) compliance with legal obligations; and (d) our legitimate interests (such as improving the Services, preventing fraud, and ensuring security).
International Transfers. Your personal data may be transferred to and processed in the United States and other countries outside the EEA/UK. Such transfers are made pursuant to appropriate safeguards, including Standard Contractual Clauses approved by the European Commission.
Right to Withdraw Consent. Where we rely on your consent to process personal data, you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Right to Lodge a Complaint. You have the right to lodge a complaint with a supervisory authority in the EEA member state or UK country of your habitual residence, place of work, or place of an alleged infringement of the GDPR.
Limitation of Liability. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law in your jurisdiction. The arbitration and class action waiver provisions in Section 14 may not be enforceable in certain EEA/UK jurisdictions. In such jurisdictions, Disputes shall be resolved in the competent courts of your country of residence.

Ask Baseline iOS App — Subscription Terms
This section supplements the Terms of Service above and applies specifically to the Ask Baseline iOS application and any subscription purchased through it. Where this section conflicts with the general PeakLink Terms above, this section controls for users of the Ask Baseline iOS app.
What the app does
Ask Baseline scans product barcodes and labels, then returns a healthfulness score using publicly available ingredient and nutrition data combined with your stated preferences. Ask Baseline is an educational tool and is not a medical device. Scores are informational only and are not a substitute for advice from a qualified healthcare professional. Statements about products have not been evaluated by the FDA. Ask Baseline does not diagnose, treat, cure, or prevent any disease.
Eligibility
You must be at least 13 years old to use the Ask Baseline iOS app. If you are between 13 and the age of majority in your jurisdiction, you must have a parent or legal guardian’s permission.
Subscription, trial, and auto-renewal
Ask Baseline offers an auto-renewing subscription with the following terms:
- Annual plan: $39.99 per year, billed annually after a 7-day free trial.
- Monthly plan: $7.99 per month, no trial.
Auto-renewal disclosure (required by Apple):
Your subscription automatically renews for the same plan and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your iTunes / App Store account will be charged for renewal within 24 hours prior to the end of the current period, at the price disclosed at purchase. You can manage and cancel your subscriptions in your App Store account settings after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.
How to cancel
You can cancel your subscription at any time through your iOS device:
- Open the Settings app on your iPhone or iPad.
- Tap your name at the top, then tap Subscriptions.
- Tap Ask Baseline, then tap Canc>
Cancellation takes effect at the end of the current paid period; you retain access until then. Cancelling before the end of a free trial prevents the first charge.
Refunds
Refunds for subscriptions purchased through the App Store are handled by Apple under Apple’s policies. Request a refund through Standard End User License Agreee provided a separate custom EULA. Apple is not a party to the relationship between you and us, and Apple is not responsible port, or any claims related to it.
Use of AI
The Ask Baseline iOS app uses third-party AI services (Anthropic’s Claude and Google’s Gemini) to generate ingredient explanations, score rationales, and personalized product recommendations. AI-generated responses can sometimes be incomplete or incorrect. Always read the actual product label
